Mr. Bays is actively involved in all phases of intellectual property law, with a particular emphasis in litigation, post grant proceedings at the U.S. Patent and Trademark Office such as Inter Partes Review (IPR), patent preparation and prosecution, IP due diligence, licensing and client counseling. Mr. Bays has extensive experience in formulating patent strategies and rendering opinions on patent validity, patent infringement, technology licensing, and the protection of trade secrets and other proprietary information. He also has acted as trial counsel in numerous jury and bench trials and related appellate proceedings involving patents and trade secrets and in diverse technical fields including generic pharmaceuticals (Hatch-Waxman Act), polymeric membranes, industrial specialty chemicals, telecommunications equipment, medical devices and household goods. Other fields in which he has experience include electrical connectors, powertrains, transmissions, fluid handling systems, printing presses and other complex manufacturing machinery and processes.

Mr. Bays has been involved in patent litigation over various blockbuster medicines, including buprenorphine/naloxone (Suboxone®), cinacalcet (Sensipar®), esomeprazole (Nexium®), tigecycline (Tygacil®), adapalene (Differin®), buprenorphine (Butrans®), doxepin (Silenor®), sildenafil (Viagra®), and venlafaxine (Effexor® XR).
