Agfa Defeats All Of Kodak's Infringement Claims
April 30, 2008CHICAGO, April 30, 2008 – On April 22, 2008, Judge Telesca of the Western District of New York adopted in full the recommendations of a special master determining that Agfa had not infringed three Kodak patents and that Kodak had not given proper notice of the patents. Four other patents were dismissed from the suit earlier. The net result of the decision and earlier decisions on summary judgment is that all of Kodak’s claims of infringement against a dozen Agfa films have failed. The suit was originally filed in 2002 and went to trial before the special master in May 2007.
The patents in question were U.S. Patent Numbers 4,425,425, 4,425,426, and 4,439,520.
