Federal Circuit Affirms Agfa's Defeat of Kodak's Infringement Claims

CHICAGO – On November 9, 2009, the Court of Appeals for the Federal Circuit affirmed the United States District Court for the Western District of New York’s decision finding that Agfa owed nothing on Kodak’s claims of patent infringement relating to Agfa’s x-ray film products. Of seven Kodak patents originally involved in the dispute, four were dismissed prior to trial. At trial, the District Court found the remaining patents not infringed for most products and for two minor products, the Court determined that no proper notice of infringement had been given to Agfa. The net result of the trial court’s decisions in Agfa’s favor is that Agfa has defeated all of Kodak’s claims under seven patents involving more than a dozen Agfa films. The suit was originally filed in 2002 and went to trial in May 2007.
